Scenario:
During a patrol at sea, you happen upon a set of fixed gear that is deployed in a shallow water prohibited area. You also notice that the gear has entangled several birds and porpoises. The surface markers comply with the regulations clearly marked with vessel name and PLN. You are not sure if the gear was purposely set in the area, or if it was towed there by an errant trawler.
Questions
1. Explain what powers you have (if any) as an enforcement officer under MACAA (not any other specific powers you may have under other legislation) to haul and remove the gear from the water?
2. If you do have powers to remove fishing gear from the water, what can you do with it and under what circumstances? Explain all the powers available to you.
3. What onus is placed on you if you do lift gear? Explain all the powers available to you.
