Assignment:

You will need to read the scenario below and when answering the associated questions EXPLAIN in your own words the powers available to you in different situations.

Do not copy large pieces of legislation verbatim, answer in your own words to show an understanding of the legislation.


Scenario:

You are walking along the quay and observe a fishing vessel landing boxes  onto the quay, which are then being loaded into the back of a merchants van. As you approach the van the person loading the boxes, closes the back of the van door, leaving a box on the quayside. You observe that box contains bass many of which appear small and in your opinion may well be undersize. You explain to the man, that you are an enforcement officer and you want to see the boxes in the back of the van.

Questions:

1.    The man asks your name and wants to see your warrant, what must you do and explain the powers you would be acting under?

2.    The man refuses to open the van and it is locked. Explain the powers you have to inspect and search the van?

3.    Will the man have committed any offences by refusing to open the van? If so explain the relevant powers.

4.    When searching the van, you request that the man observes what you are doing, he ignores you and walks away. Explain the powers you have to ensure that he remains present?

5.    50 bass are undersized. Explain the power you have to seize this fish?
